its a long story lol ive struggled for months with my connection working with virgin on a fix but my contract ran out so i decided to leave rang them up asked to leave they asked where i was going so i told them i had not found a new supplier. so the girl explained that with covid ext its taking a long time for new connections to be setup so i best find a deal then come back to them so i agreed and a loyalty she dropped my bill i refused saying i didn't want ant new contracts but was asured this is not the case. so i have looked around picked zen after advice from members on here rang virgin back who are now telling me i am on a 18 month contract. i stated the above to them so they said they would prove otherwise with the recording of the phone call. me im happy with this as they are full of shit 2 days later i get a phone call to say they have lost the recording but believe im under contract and they want to hold me to it but im struggling to even join oldg nights things are so bad but obviously me v virgin isnt going to end well for me

Wow

Sounds like crap, I can’t speak highly enough of Virgin. The TiVo isn’t sky but now have the virgin 360 tv and so far seems ok. Internet side never had any issue at all. We tried sky internet  once and within 3 days we cancelled and went back to virgin.

If Virgin cant prove your under contract (because they have "lost a phone call" or whatever) that's their problem not yours.
The onus is on them to prove this I believe.
I would write them a letter and send it recorded and give them 7 days from receipt of letter to provide evidence of any contractual obligation.
You could also mention in this same letter, that even if you WERE under contract, which according to own records you are not then they are breach of contract for failing to provide the level of service for which you are paying.
But I don't know if I would bother with the latter. Simply saying "my records say im out of contract, prove im not" and giving them 7 days notice to provide it should do.

Maybe a 'subject access request' under data protection would at least show they recieved your call. And if they do indeed have the recording they'd need to disclose it.
